Baby Depicted in the Nirvana Cover “Nevermind” Files a Federal Lawsuit

The man who was featured on the album cover “Nevermind” by Nirvana has filed a lawsuit alleging it violated federal child pornography laws. Spencer Elden, the baby depicted in the album cover that has circulated around the world over the last 30 years, claimed his parents never signed a release allowing Nirvana to use the photograph.

In his lawsuit filed in Los Angeles federal court, Elden argues that his “identity and legal name are forever tied to the commercial sexual exploitation he experienced as a minor, which has distributed and sold worldwide from the time he was a baby to present day.”

Elden theorizes that all defendant's knowingly produced and advertise child pornography and they knowingly received value by doing so.

The album cover depicts Elden when he was four months old swimming under water in  a pool. The lawsuit further alleges that Kurt Cobain suggested that it mean a “sex worker grabbing for a dollar bill.”

Elden is asking for $150,000 from each of the 17 defendants.
